Prosecutors have decided NOT to charge former NHL star Mike Comrie with rape, after confirming there was enough reasonable doubt coming from his accuser’s story to make charges impossible to file.

Hilary Duff‘s ex was being investigated the past few weeks for an incident that occurred on February 11 at his El Lay home, in which he invited two women over for drinks and sex.

The accuser had told police that she waited while Comrie had sex with the first woman, and after that woman left, the accuser and Comrie apparently had consensual sex. At some point, though, according to the accuser, Comrie crossed the line by engaging in anal sex — and she alleges she told him to stop, though he refused and eventually choked her.

Things get messy for prosecutors from here on, though; instead of leaving afterwards, the woman reportedly showered and then engaged in another consensual sex act with Comrie, during which he allegedly got rough with her again and slapped her in the face.

The woman recorded Comrie’s voice on her phone after that — cops contend the former NHL star did sound very drunk — but after a medical examination of the accuser, authorities concluded that they could not prove Comrie committed rape beyond a reasonable doubt.

Therefore, they will not move forward with charges, and it looks like this investigation into Hilary Duff’s ex-husband has been completely closed.
